{"id":9635,"date":"2021-01-21T14:13:53","date_gmt":"2021-01-21T13:13:53","guid":{"rendered":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/?p=9635"},"modified":"2021-01-21T14:13:53","modified_gmt":"2021-01-21T13:13:53","slug":"11-changes-landlords-can-expect-from-2021","status":"publish","type":"post","link":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/11-changes-landlords-can-expect-from-2021\/","title":{"rendered":"11 Changes Landlords Can Expect from 2021"},"content":{"rendered":"\n<p>We&#8217;re a month into 2021 and it&#8217;s already looking to be a jam-packed year for landlords and letting agents. <\/p>\n\n\n\n<p>As we all know by now, the lettings industry can be unpredictable at the best of times, let alone when there&#8217;s a global pandemic. To help you be prepared and save you any sudden surprises, we&#8217;ve put together a list of changes and updates you can expect from the year ahead.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Dogs and Domestic Animals Bill &#8211; February 2021<\/h2>\n\n\n\n<p>Conservative MP Andrew Rosindell\u2019s <strong><a href=\"https:\/\/bills.parliament.uk\/bills\/2791\" target=\"_blank\" rel=\"noreferrer noopener\">Dogs and Domestic Animals (Accommodation and Protection) Bill<\/a><\/strong> aims to give tenants the right to live with their pet without their landlord\u2019s approval \u2013 as long as they can prove they are responsible owners.<\/p>\n\n\n\n<p>The first reading for this proposed new law was on 14th October 2020, and the second reading is set to happen on the <strong>26<sup>th<\/sup> February 2021<\/strong>. The Dogs and Domestic Animals Bill is being supported by a number of animal welfare charities including the RSPCA.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">End of mortgage payment holidays &#8211; March 2021<\/h2>\n\n\n\n<p>To help those who have been financially impacted by the coronavirus, homeowners are able to apply for a mortgage payment holiday until <strong>March 31<sup>st<\/sup><\/strong> <strong>2021<\/strong>.<\/p>\n\n\n\n<p>If you have not taken a payment holiday or &#8216;deferral&#8217; at all during the pandemic, you can apply for a maximum deferral\/payment holiday of up to 6 months.<\/p>\n\n\n\n<p>If you currently have your first deferral in place or have resumed payments after one deferral, you can apply for another one to take you up to the six-month limit. If you\u2019ve already had six months\u2019 worth of deferrals, you won\u2019t be eligible for further payment holidays and will need to seek alternative support. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Mandatory electrical reports for all tenancies &#8211; April 2021<\/h2>\n\n\n\n<p>From 1st July 2020, Electrical Installation Condition Reports (EICRs) became a legal requirement for all <strong>new<\/strong> tenancies in England and Wales.<\/p>\n\n\n\n<p>From 1st April 2021,  this requirement will extend to all tenancies, new and existing.<\/p>\n\n\n\n<p>The new regulations hope to ensure all rental properties are electrically safe. A qualified engineer must visit the property to inspect and test all fixed-wirings and provide a report of their findings. If you haven&#8217;t already, we recommend you <a href=\"https:\/\/www.https:\/\/www.lettingaproperty.com\/electrical-installation-condition-report\" target=\"_blank\" rel=\"noreferrer noopener\">sort your electrical inspection now<\/a> to avoid the last-minute rush.<\/p>\n\n\n\n<p class=\"cta\">Book your <a href=\"https:\/\/www.lettingaproperty.com\/electrical-installation-condition-report\" target=\"_blank\" rel=\"noreferrer noopener\">EICR<\/a> now!<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Client Money Protection (CMP) &#8211; April 2021<\/h2>\n\n\n\n<p>In April 2019, it became mandatory for letting agents in England to belong to a <a href=\"https:\/\/www.gov.uk\/client-money-protection-scheme-property-agents\" target=\"_blank\" rel=\"nofollow noopener\">client money protection scheme<\/a>. This was brought in to ensure all funds from tenants and landlords are fully protected.<\/p>\n\n\n\n<p>There was initially a 12-month grace period for agents to comply with the regulations, however, the deadline was pushed back to <strong>April 1st 2021<\/strong>. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Expected end of 6-month notice periods &#8211; June 2021<\/h2>\n\n\n\n<p>Due to the pandemic, landlords are currently legally obliged to give tenants six months\u2019&nbsp;<a href=\"https:\/\/www.gov.uk\/government\/news\/jenrick-extends-ban-on-evictions-and-notice-periods\" rel=\"nofollow\">notice for all evictions<\/a>.<\/p>\n\n\n\n<p> There are exceptions for certain circumstances &#8211; such as domestic abuse, anti-social behaviour, and more than six months of rent arrears. <\/p>\n\n\n\n<p>The government announced a further extension to the current ban on bailiff-enforced evictions in England until at least May 31<sup>st<\/sup> where normal notice periods were expected to resume. This means that until the 31<sup>st<\/sup>&nbsp;May private landlords will need to continue to give tenants six months\u2019 notice before they can repossess properties.<\/p>\n\n\n\n<p>On Wednesday 12 May, Housing Minister Christopher Pincher approved changes to eviction legislation that will restart bailiff enforcement from 1 June. This means that from 1 June, eviction notice periods will be reduced to four months.<\/p>\n\n\n\n<p><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Stamp Duty holiday extension &#8211; June 2021<\/h2>\n\n\n\n<p>On the 3rd March 2021, Chancellor Rishi Sunak announced an extension for the government&#8217;s Stamp Duty holiday beyond the original deadline of 31st March until the end of June.<\/p>\n\n\n\n<p>From&nbsp;<strong>1st&nbsp;July to 30th&nbsp;September 2021<\/strong>, there will be no Stamp Duty chargeable on the first \u00a3250,000 of a property purchase price.<\/p>\n\n\n\n<p>From&nbsp;<strong>1st&nbsp;October 2021<\/strong>&nbsp;onwards, the nil rate band will return to \u00a3125,000, as before the Stamp Duty holiday.<\/p>\n\n\n\n<p>Although the Stamp Duty changes have affected first-time buyers the most, landlords and property investors have still benefitted from the raised threshold. <\/p>\n\n\n\n<p>Find out more: <a href=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/landlord-stamp-duty-buy-to-lets\/\" target=\"_blank\" rel=\"noreferrer noopener\">Landlord Stamp Duty: How Does The Stamp Duty Holiday Affect Buy-To-Lets?<\/a><\/p>\n\n\n\n<p>Looking for an accountant? This applies to all tenants, regardless of their background.<\/p>\n\n\n\n<p>With Brexit bringing in a point-based system from 1st January 2021, landlords have been told to continue using passports and national ID cards as an interim measure until <strong>30th June<\/strong> <strong>2021<\/strong>.<\/p>\n\n\n\n<p class=\"cta\">Read more: <a href=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/coronavirus-right-to-rent\/\">Right to Rent Checks and Coronavirus<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Possible abolition of Section 21<\/h2>\n\n\n\n<p>In 2019, the government held a consultation regarding the abolition of Section 21 notices.<\/p>\n\n\n\n<p>Section 21 currently allows landlords to end tenancies through a &#8216;no-fault eviction&#8217;. Normally, the period of notice is two months, however, there is a temporary minimum notice period of 6 months until 31st March 2021.<\/p>\n\n\n\n<p>The removal of Section 21 was announced as part of the Renters Reform Bill last year. The bill also includes plans for lifetime tenancy deposits and a government database of rogue landlords and property agents accessible to tenants, agents, landlords, employers and professional bodies.<\/p>\n\n\n\n<p>Like many things in 2020, the Bill was put on hold due to the coronavirus. A White Paper proposal is expected in Autumn 2021.<\/p>\n\n\n\n<p>Sign up to our newsletter to receive the latest lettings updates and news straight to your inbox.<\/p>\n\n\n\n\n\n<h2 class=\"wp-block-heading\">Making Tax Digital <\/h2>\n\n\n\n<p>If you\u2019re a landlord with a rental turnover of more than \u00a385,000, you will be required to switch to the Making Tax Digital (MTD) system at <strong>some point this year<\/strong>.<\/p>\n\n\n\n<p>The MTD system requires you &#8211; the landlord &#8211; to send four quarterly submissions on income and expenses via your digital account to HMRC. This system will replace your annual tax return and you will have to a declaration to confirm the numbers are accurate.<\/p>\n\n\n\n<p>It\u2019s likely that all businesses, regardless of turnover, will have to switch to the MTD system by 2022.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Amendments to Capital Gains Tax <\/h2>\n\n\n\n<p>Although no date has been confirmed yet, tax changes are expected to happen in 2021.<\/p>\n\n\n\n<p>The government is currently reviewing the Capital Gains Tax (CGT) system and any changes may significantly affect landlords trying to sell their investment properties.<\/p>\n\n\n\n<p>In November 2020, the Office for Tax Simplification made eleven recommendations for Capital Gains Tax changes, including making rates \u2018more closely aligned\u2019 with income tax rates and reducing the CGT-free allowance. <\/p>\n\n\n\n<p>The government are currently reviewing these recommendations. It\u2019s unlikely any changes will happen soon, but this change is worth noting for 2021.<\/p>\n\n\n\n<p>Looking for a finance professional? The bill aims to amend the Renting Homes (Wales) Act 2016 to guarantee tenants a minimum of 12 months\u2019 protection against eviction at the start of a new tenancy, provided they have not breached the terms of their contract.<\/p>\n\n\n\n<p>The amendment will bring a lot of changes for tenancies, including extending the minimum notice period from two months to six months for virtually all rented properties in Wales.<\/p>\n\n\n\n<p>The provisions of the Act are not yet in force, but are expected to be brought in during <strong>Spring 2021<\/strong>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">New Scottish Smoke Alarm Law delayed until 2022<\/h2>\n\n\n\n<p>Following the Grenfell tragedy in 2017, a <a href=\"https:\/\/www.gov.scot\/publications\/fire-and-smoke-alarms-in-scottish-homes\/\" target=\"_blank\" rel=\"nofollow noopener\">new Fire and Smoke Alarm Standard<\/a> is being passed in Scotland to ensure all homeowners and tenants are protected from the threat of fire.&nbsp;<\/p>\n\n\n\n<p>This law was meant to come into force in February 2021, but has been delayed 12 months until 2022 due to COVID-19.<\/p>\n\n\n\n<p>If passed, this would mean tenants would have an assumed right to take their pet into any rented accommodation.&nbsp;<\/p>\n\n\n\n<p>When the legislation <em>is<\/em> in place, all Scottish homes must have a smoke alarm in living rooms, hallways and landings.
