{"id":9446,"date":"2020-11-06T11:49:06","date_gmt":"2020-11-06T10:49:06","guid":{"rendered":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/?p=9446"},"modified":"2020-11-06T11:49:06","modified_gmt":"2020-11-06T10:49:06","slug":"eviction-restrictions-during-second-lockdown","status":"publish","type":"post","link":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/eviction-restrictions-during-second-lockdown\/","title":{"rendered":"Government Announces Lockdown Eviction Restrictions"},"content":{"rendered":"\n<p>The government have announced that evictions will not be enforced whilst the national restrictions are in place. <\/p>\n\n\n\n<p>Bailiff enforcement action is on halt until 11 January 2021 at the earliest, except for the most serious cases, such as anti-social behaviour, fraud and illegal occupation.<\/p>\n\n\n\n<p>The courts will remain open during the national lockdown and cases of anti-social behaviour and other crimes will remain a priority.<\/p>\n\n\n\n<p>Eviction notices can still be issued, but the six-month notice periods brought in earlier this year are expected to continue until at least March 2021.<\/p>\n\n\n\n<p>Further information on eviction proceedings can be found here: <a href=\"https:\/\/www.gov.uk\/government\/publications\/understanding-the-possession-action-process-guidance-for-landlords-and-tenants\/understanding-the-possession-action-process-a-guide-for-private-landlords-in-england-and-wales#stages-of-the-possession-process\" target=\"_blank\" rel=\"noreferrer noopener\">GOV.UK Understanding the Possession Action Process<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Statement from the Housing Secretary<\/h2>\n\n\n\n<p>Housing Secretary Robert Jenrick MP has issued the <a href=\"https:\/\/www.gov.uk\/government\/news\/new-protections-for-renters-over-duration-of-national-restrictions\" target=\"_blank\" rel=\"noreferrer noopener\">following statement<\/a>: <\/p>\n\n\n\n<p>&#8220;<em>We have already taken unprecedented action to support renters during the pandemic including introducing a 6 month notice period and financial support to help those struggling to pay their rent.<\/em><\/p>\n\n\n\n<p>&#8220;<em>We are now going further by protecting renters from eviction during the new national restrictions and throughout the Christmas period \u2013 with a pause on bailiff activity other than in the most serious circumstances, such as anti-social behaviour or fraud.<\/em><\/p>\n\n\n\n<p>&#8220;<em>Striking the right balance between helping tenants in need while ensuring landlords have access to justice in the most serious cases<\/em>.&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Exempt circumstances<\/h2>\n\n\n\n<p>Whilst national restrictions apply, there are several circumstances that are <strong>exempt<\/strong> from the latest eviction protection measures. This includes: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Illegal occupation<\/li><li>Fraud<\/li><li>Anti-social behaviour<\/li><li>Domestic abuse perpetrators in social housing<\/li><li>Where a property is unoccupied following the death of a tenant<\/li><\/ul>\n\n\n\n<p>The government also intend to introduce an exemption for extreme pre-Covid rent arrears, but there is no further information on this as of yet.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Rental market stays open<\/h2>\n\n\n\n<p>The Ministry of Housing has clarified that the housing market will remain open during the national lockdown; allowing move-ins, property viewings and visits from tradespeople to continue. <\/p>\n\n\n\n<p>Jenrick has encouraged anyone moving home or visiting properties throughout the lockdown period to <em>&#8220;following the current guidance&#8221;<\/em> and <em>&#8220;continue to play their part in reducing the spread of the virus&#8221;<\/em>.<\/p>\n\n\n\n<p>View the latest government guidance on viewings and move-ins here: <a href=\"https:\/\/www.gov.uk\/guidance\/government-advice-on-home-moving-during-the-coronavirus-covid-19-outbreak\" target=\"_blank\" rel=\"noreferrer noopener\">GOV.UK Advice on Home Moving During the Coronavirus Outbreak<\/a>.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Stay COVID-safe with virtual viewings<\/h2>\n\n\n\n<p>To minimise public health risks, the government advise that virtual viewings are carried out where possible before visiting properties in person.<\/p>\n\n\n\n<p>We are pleased to offer a professional virtual tour service, allowing tenants to &#8216;visit&#8217; your property directly from your property advert.
