{"id":9320,"date":"2020-09-01T15:05:40","date_gmt":"2020-09-01T14:05:40","guid":{"rendered":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/?p=9320"},"modified":"2020-09-01T15:05:40","modified_gmt":"2020-09-01T14:05:40","slug":"six-month-notices","status":"publish","type":"post","link":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/six-month-notices\/","title":{"rendered":"Government Announces 6-Month Notice Periods and Eviction &#8216;Ban&#8217; Extension"},"content":{"rendered":"\n<p>The government have extended the stay on possession proceedings and increased eviction notice periods to 6 months.<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li><a href=\"#extended-possession-proceedings\">Extended stay on possession proceedings<\/a><\/li><li><a href=\"#future-eviction-proceedings-landlords\">Court proceedings after 20th September<\/a><\/li><li><a href=\"#6-month-eviction-notices\">6-month eviction notice periods<\/a><\/li><li><a href=\"#6-month-eviction-exemptions\">Exemptions to 6-month notice periods<\/a><\/li><li><a href=\"#6-month-notices-wales-scotland\">6-month notices in Wales and Scotland<\/a><\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"extended-possession-proceedings\">Extended stay on possession proceedings<\/h2>\n\n\n\n<p>On Friday 21st August, the government made a last-minute decision to extend the eviction ban until 20th September 2020.<\/p>\n\n\n\n<p>Housing Secretary Robert Jenrick MP says the extension will help &#8220;support renters over winter&#8221; and will &#8220;support landlords to progress the priority cases&#8221; once the courts reopen.<\/p>\n\n\n\n<p>Many in the industry are furious at the government&#8217;s sudden U-turn. Agents and landlords were preparing eviction paperwork ready for the end of the ban, only for it to be extended another month.<\/p>\n\n\n\n<p>Whilst many landlords and agents suspected the government would make a quick change, it was hoped that any possession proceedings involving rent arrears built up before the pandemic would still be allowed to go ahead.<\/p>\n\n\n\n<p>Paul Shamplina of Landlord Action states: <em>&#8220;I do not believe enough consideration has been given to people in these set of circumstances and perhaps rather than a blanket ban, existing cases should have been allowed to restart as planned&#8221;.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"future-eviction-proceedings-landlords\">Court proceedings after 20th September<\/h2>\n\n\n\n<p>Unless there is yet another extension, court proceedings should resume on 20th September 2020.<\/p>\n\n\n\n<p>The process for evictions has undergone some changes to help ease the <em>&#8220;increasing volume&#8221;<\/em> of evictions expected after the 6-month ban.<\/p>\n\n\n\n<p>These changes include &#8220;reactivation notices&#8221; for those who wish to resume halted proceedings and the requirement to provide courts with information regarding how the tenant has been affected by the COVID-19 pandemic.<\/p>\n\n\n\n<p class=\"cta\">View the full <a href=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/changes-to-evictions-august-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">changes to eviction proceedings<\/a> in our <a href=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/changes-to-evictions-august-2020\/\" target=\"_blank\" rel=\"noreferrer noopener\">previous article<\/a>.<\/p>\n\n\n\n<p>The government says they have made these changes with <em>&#8220;practical issues&#8221; <\/em>in mind and hope to<em> &#8220;promote best practice and consistency [&#8230;] in the continuing context of the pandemic and the economic situation&#8221;.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"6-month-eviction-notices\">6-month eviction notice periods<\/h2>\n\n\n\n<p>The government have also introduced <a href=\"https:\/\/www.gov.uk\/government\/news\/government-has-changed-the-law-so-most-renters-have-a-6-month-notice-period\" target=\"_blank\" rel=\"noreferrer noopener\">6-month notice periods<\/a> in England. <\/p>\n\n\n\n<p>Effective from 29th August, landlords must provide at least 6 months&#8217; notice prior to seeking possession through the courts, including Section 21 evictions and rent arrears under 6 months.<\/p>\n\n\n\n<p>The new legislation applies to both private and social rented sectors and to all new notices, but not to any notices issued before the legislation comes into force (29th August).<\/p>\n\n\n\n<p>Notices served on and before 28th August are not affected by these changes, and must be at least 3 months.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"6-month-eviction-exemptions\">Exemptions to 6-month notice periods<\/h2>\n\n\n\n<p>To help landlords in the worst cases, the government have provided some exemptions to the 6-month notice periods:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Anti-social behaviour (now 4 weeks\u2019 notice)<\/li><li>Domestic abuse (now 2 to 4 weeks\u2019 notice)<\/li><li>False statement (now 2 to 4 weeks\u2019 notice)<\/li><li>Over 6 months\u2019 accumulated rent arrears (now 4 weeks\u2019 notice)<\/li><li>Breach of immigration rules \u2018Right to Rent\u2019 (now 3 months\u2019 notice)<\/li><\/ul>\n\n\n\n<p class=\"cta\">Our fixed-fee rental plans include <a href=\"https:\/\/www.lettingaproperty.com\/landlord\/lettings\" target=\"_blank\" rel=\"noreferrer noopener\">\u00a350,000 of Legal Expenses Cover<\/a> &#8211; starting from \u00a339 a month (inc VAT).<\/p>\n\n\n\n<h2 class=\"wp-block-heading\" id=\"6-month-notices-wales-scotland\">6-month notices in Scotland and Wales<\/h2>\n\n\n\n<p>In Wales, eviction notice periods have been extended to 6 months until 30th September 2020.<\/p>\n\n\n\n<p>With England implementing their extension until March 2021, the Welsh government could push this date back further in the weeks to come.<\/p>\n\n\n\n<p>In Scotland, The Coronavirus (Scotland) Act 2020 protects tenants from any eviction action and extends notice periods to 6 months.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Industry thoughts<\/h2>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>&#8220;The government&#8217;s last-minute U-turn is extremely frustrating for landlords and letting agents&#8221;.<\/p><p>&#8220;Throwing 6-month notice periods into the mix was yet another blindsided blow for the PRS, but hopefully, the announced exemptions will be a starting point for landlords dealing with the worst-case scenarios&#8221;.<\/p><cite>Jonathan Daines, CEO and Founder of LettingaProperty.com<\/cite><\/blockquote>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\"><p>\u201cPrivate landlords cannot be expected to foot the bill for government failure.
