{"id":9100,"date":"2020-04-05T07:33:02","date_gmt":"2020-04-05T06:33:02","guid":{"rendered":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/?p=9100"},"modified":"2020-04-05T07:33:02","modified_gmt":"2020-04-05T06:33:02","slug":"coronavirus-right-to-rent","status":"publish","type":"post","link":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/coronavirus-right-to-rent\/","title":{"rendered":"Coronavirus and Right to Rent Checks: Temporary Changes for Landlords"},"content":{"rendered":"\n<p>On 30th March 2020, the government announced some <a href=\"https:\/\/www.gov.uk\/guidance\/coronavirus-covid-19-landlord-right-to-rent-checks\">temporary changes<\/a> to the rules of Right to Rent checks. These changes aim to make it easier for landlords to carry them out.<\/p>\n\n\n\n<p>The changes are: <\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Checks can now be carried out <strong>via video call<\/strong><\/li><li>Tenants can <strong>send scanned documents or a photo of documents for checks using email or a mobile app<\/strong>, rather than sending originals<\/li><li>Landlords should use the&nbsp;<strong><a href=\"https:\/\/eforms.homeoffice.gov.uk\/outreach\/lcs-application.ofml\">Landlord\u2019s Checking Service<\/a>&nbsp;<\/strong>if a prospective or existing tenant cannot provide any of the existing documents<\/li><\/ul>\n\n\n\n<p>Checks will continue to be necessary and landlords must continue to check the prescribed documents of their tenants.  It remains an offence to knowingly let a property to a person who is not lawfully in the UK. <\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Carrying out the check<\/h2>\n\n\n\n<p>The government have advised that the following measures should now be taken when conducting a Right to Rent check:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Ask the tenant to <strong>submit a scanned copy or a photo of their original documents via email<\/strong> or using a mobile app<\/li><li>Arrange a video call with the tenant \u2013 ask them to <strong>hold up the original documents to the camera<\/strong> and check them against the digital copy of the documents<\/li><li><strong>Record the date you made the check<\/strong> and mark it as \u201can adjusted check has been undertaken on [insert date] due to COVID-19\u201d<\/li><\/ul>\n\n\n\n<p class=\"cta\">Find out more about COVID-19 and the PRS: <a href=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/coronavirus-landlord-tenant\/\">Coronavirus: Landlord &amp; Tenant Information (April 2020)<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What if my tenant doesn&#8217;t have the right documents?<\/h2>\n\n\n\n<p>Because of COVID-19, some individuals will be unable to evidence their right to rent. <\/p>\n\n\n\n<p>During this time, landlords must take extra care to ensure that no-one is discriminated against because they are struggling to evidence their right to rent. <\/p>\n\n\n\n<p class=\"cta\">For more information, please see the&nbsp;<a href=\"https:\/\/www.gov.uk\/government\/publications\/right-to-rent-landlords-code-of-practice\">Code of Practice for Landlords: Avoiding Unlawful Discrimination When Conducting Right to Rent Checks in the Private Rented Residential Sector<\/a><\/p>\n\n\n\n<p>If a tenant cannot provide documents from the&nbsp;<a href=\"https:\/\/www.gov.uk\/government\/publications\/right-to-rent-document-checks-a-user-guide\">prescribed lists<\/a>, landlords must contact the&nbsp;<a href=\"https:\/\/eforms.homeoffice.gov.uk\/outreach\/lcs-application.ofml\">Landlord\u2019s Checking Service<\/a>. The government have stated that they will respond to requests within 2 working days and a advise that landlords keep their responses to protect against a civil penalty.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What happens to Right to Rent checks <em>after <\/em>COVID-19 measures end?<\/h2>\n\n\n\n<p>When the temporary measures end, landlords must r<strong>evert back to the original Right to Rent checks procedures<\/strong> outlined in the government&#8217;s <a href=\"https:\/\/www.gov.uk\/government\/publications\/right-to-rent-landlords-code-of-practice\/code-of-practice-on-illegal-immigrants-and-private-rented-accommodation-for-tenancies-starting-on-or-after-1-february-2016\">Code of Practice on Illegal Immigrants and Private Rented Accommodation<\/a> and <a href=\"https:\/\/www.gov.uk\/government\/publications\/right-to-rent-document-checks-a-user-guide\">Right to Rent Checks: A User Guide<\/a>.<\/p>\n\n\n\n<p>The government advises that landlords carry out <strong>retrospective checks <\/strong>on tenants who:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>started their tenancy during this period<\/li><li>required a follow-up check during this period<\/li><\/ul>\n\n\n\n<p>You should <strong>mark the retrospective check<\/strong>: \u201cthe individual\u2019s tenancy agreement commenced on [insert date]. The prescribed right to rent check was undertaken on [insert date] due to COVID-19.\u201d<\/p>\n\n\n\n<p>The retrospective check must be c<strong>arried out within 8 weeks of the COVID-19 measures ending<\/strong>. Both checks should be kept for your records.<\/p>\n\n\n\n<p>The Home Office have stated that they will not take any enforcement action against landlords that have carried out <strong>an adjusted check set out by their guidance<\/strong> or a <strong>check via the Home Office<\/strong> and followed this up with the <strong>retrospective check<\/strong>.<\/p>\n\n\n\n<p>If, at the point of carrying out the retrospective check, you find your tenant, (who started their tenancy during this period) did not have a right to rent, the government advises that <strong>you must take steps to&nbsp;<a href=\"https:\/\/www.gov.uk\/government\/publications\/ending-a-residential-tenancy-agreement\">end the tenancy<\/a><\/strong>.<\/p>\n\n\n\n<p>If you discover that a tenant who required a follow-up check during this period <strong>no longer has a right to rent<\/strong>, you must&nbsp;<a href=\"https:\/\/www.gov.uk\/check-tenant-right-to-rent-documents\/further-checks\">report this to the Home Office<\/a>&nbsp;as soon as you have carried out the check.<\/p>\n\n\n\n<p>If the check you have undertaken during this period <strong>was done with original documentation<\/strong>, you <strong>do not<\/strong> need to undertake a retrospective check.<\/p>\n\n\n\n<p>This information was taken from the government&#8217;s official guidance issued on 30th March 2020: <a href=\"https:\/\/www.gov.uk\/guidance\/coronavirus-covid-19-landlord-right-to-rent-checks\">Coronavirus (COVID-19): Landlord Right to Rent Checks<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p><span class=\"span-reading-time rt-reading-time\" style=\"display: block;\"><span class=\"rt-label rt-prefix\">Reading Time: <\/span> <span class=\"rt-time\"> 3<\/span> <span class=\"rt-label rt-postfix\">minutes<\/span><\/span>On 30th March 2020, the government announced some temporary changes to the rules of Right to Rent checks.
