{"id":6119,"date":"2017-08-04T19:04:35","date_gmt":"2017-08-04T18:04:35","guid":{"rendered":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/?p=6119"},"modified":"2017-08-04T19:04:35","modified_gmt":"2017-08-04T18:04:35","slug":"minimum-energy-efficiency-standards-2018","status":"publish","type":"post","link":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/minimum-energy-efficiency-standards-2018\/","title":{"rendered":"Minimum Energy Efficiency Standards 2018 &#8211; What you need to know"},"content":{"rendered":"\n<p>As of&nbsp;<strong>1st April 2018<\/strong>&nbsp;any properties rented out in the private rented sector to meet&nbsp;a <a href=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/all-you-need-to-know-about-your-epc\/\">minimum energy performance rating<\/a> on an Energy Performance Certificate (EPC).<\/p>\n\n\n\n<p>In a bid to cut energy bills and carbon emissions, the Minimum Energy Efficient Standards 2018 (MEES) for non-domestic buildings, as announced by the Department for Energy and Climate Change, will be set to an&nbsp;<strong>EPC rating of E<\/strong>. In short, it means that it will be&nbsp;<strong>unlawful to let or lease a residential property with a poor rating<\/strong>. <\/p>\n\n\n\n<p><em><strong>Note:<\/strong> this article was written in 2017 and may contain information that has since been updated.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Why do we need Minimum Energy Efficiency Standards?<\/h2>\n\n\n\n<p>Thought to be the most significant piece of legislation to affect our existing building stock in a generation, it will force landlords to upgrade the energy efficiency of hundreds of thousands of homes currently rated F and G. And, if they don\u2019t, they will face being unable to let them until they improve the rating.<\/p>\n\n\n\n<p>In 2017, almost 10% of England and Wales\u2019 4.2 million privately rented homes  fell below the E rating &#8211; and there&#8217;s still work to be done.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A positive change<\/h2>\n\n\n\n<p>Landlords will be able to let out&nbsp;<a rel=\"noreferrer noopener\" href=\"http:\/\/www.thisismoney.co.uk\/money\/mortgageshome\/article-2877460\/Landlords-need-upgrade-older-properties-make-energy-efficient-2018.html\" target=\"_blank\">F and G rated properties<\/a>&nbsp;beyond 1 April 2018 for the remainder of existing rental contracts, but will not be able to renew a contract or let the property to someone else until it is brought up to an E rating.<\/p>\n\n\n\n<p>Whilst we think that some landlords may consider this new announcement as too much red tape, we\u2019re sure that most will agree that it\u2019s a positive move forward to reducing energy bills of tenants who are on low wages and perhaps paying over the odds for poorer standards of accommodation.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">A landlord&#8217;s perspective on the Minimum Energy Efficiency Standards<\/h2>\n\n\n\n<p> One of our landlord\u2019s Erika Pilkington, comments: \u201c<em>The MEES&nbsp;targets set by government cannot be achieved cost-effectively on many hard to treat properties \u2013 in particular older end of terrace&nbsp;or detached houses&nbsp;with solid walls. If these properties cannot be rented out, the&nbsp;unintended consequence may well be that many&nbsp;homes that are removed from the PRS, will become unsaleable, and the housing stock will be further reduced. &nbsp;Instead, it makes far more sense to incentivise&nbsp;renewable energy for hard to treat housing,&nbsp;thereby reducing the carbon footprint of these properties and helping those in fuel poverty.<\/em>&#8221; <\/p>\n\n\n\n<p>Experienced landlord Mary Latham has also urged others to take the Minimum Energy Efficiency Standards seriously: &#8220;<em>If you are buying a <\/em><a href=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/renting-out-a-house\/\"><em>property to rent out<\/em><\/a><em> make sure that the <\/em><strong><em>minimum energy efficiency standards 2018<\/em><\/strong><em> are met (rated E or above) or be prepared to spend the money needed to reach that level. &nbsp;If you are letting properties which are below an E, please take steps to get them up.<\/em><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">Steps to be taken<\/h2>\n\n\n\n<p>For tenancies which began after 1<sup>st<\/sup> October 2015, the EPC must be given to all new tenants at the start of the tenancy, otherwise a valid Section 21 cannot be served. This requirement was introduced in the Deregulation Act 2015 and has since caught out many landlords and letting agents. Even where a tenant has lived in a property for years, that landlord must bring the property up to a minimum of E, unless it is an <a href=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/epc-listed-buildings\/\">exempt listed building<\/a>.<\/p>\n\n\n\n<p>Anyone can check the EPC of any property by putting the post code into the <a rel=\"noreferrer noopener\" href=\"https:\/\/www.epcregister.com\/\" target=\"_blank\">EPC register.<\/a>&nbsp;This means that local authorities and prospective tenants have access to this information. <\/p>\n\n\n\n<p class=\"cta\">Make sure your property meets the Minimum Energy Efficiency Standards 2018 and arrange to renew your <a rel=\"noopener noreferrer\" href=\"https:\/\/www.lettingaproperty.com\/landlord\/energy-performance-certificate\" target=\"_blank\">Energy Performance Certificate<\/a> today for just \u00a369 inc.
