{"id":4313,"date":"2014-02-14T14:13:13","date_gmt":"2014-02-14T14:13:13","guid":{"rendered":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/?p=4313"},"modified":"2014-02-14T14:13:13","modified_gmt":"2014-02-14T14:13:13","slug":"my-tenant-has-stopped-paying-rent","status":"publish","type":"post","link":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/my-tenant-has-stopped-paying-rent\/","title":{"rendered":"My Tenant Has Stopped Paying Rent!"},"content":{"rendered":"<p>This is the third article in my series of <a title=\"Tenancy and Property Management Tips\" href=\"\/landlord\/blog\/2013\/12\/tenancy-property-management-tips-landlords\/\" rel=\"self\">tenancy and property management tips for landlords<\/a>.<\/p>\n<p>Hopefully, if you have taken on the points in my previous posts, we should not be getting to the stage of what happens when the tenant stops paying rent.\u00a0 However and unfortunately, even if you follow the letter to the t, there are many reasons out of our control why the tenant would default on rent.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-4314\" src=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/wp-content\/uploads\/2014\/02\/Tenant-Stops-Paying-Rent.jpg\" alt=\"Tenant Stops Paying Rent\" width=\"555\" height=\"368\" srcset=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/wp-content\/uploads\/2014\/02\/Tenant-Stops-Paying-Rent.jpg 555w, https:\/\/www.lettingaproperty.com\/landlord\/blog\/wp-content\/uploads\/2014\/02\/Tenant-Stops-Paying-Rent-528x350.jpg 528w\" sizes=\"auto, (max-width: 555px) 100vw, 555px\" \/><\/p>\n<p>It all starts with a check of your bank statement and the rent does not seem to have been paid?<\/p>\n<h3>Tip # 3 &#8211; Stay Calm<\/h3>\n<p>I would like to take a pause and remind you of my tip #3 &#8211; Stay calm and act professionally.\u00a0 This is \u2018business\u2019, try not to get too emotionally involved.\u00a0 We call this Landlord Rage at Landlord Action, which is when a landlord, can make regrettable mistakes in this process.<\/p>\n<p>Always give your tenant the opportunity to pay their rent.\u00a0 Try to understand what issues they are experiencing, i.e. job loss, marital split etc and work out a plan.\u00a0 It\u2019s better to know this now rather than 4 months down the line when the debt has become too big for them to manage.<\/p>\n<p>For example, if your rent is due on the 1st September, by the time you come to 2nd October, they will be 2 months in arrears (as rent is paid in advance) and that\u2019s when you will be ready to serve a Section 8 Notice for breach of tenancy.<\/p>\n<p>You would base your Notice on Ground 8 which is a mandatory ground where the court dealing with the case would pass judgement to grant a possession order.<\/p>\n<p>Between the 1st September and 1st October, you can write letters to your tenant reminding them that they are overdue and advise ways in which to settle.\u00a0 Be advised that if you persistently call the tenant or turn up to the property without giving the required 24 hours\u2019 notice in writing, this could be deemed as harassment.\u00a0 We have had cases where tenants have filed these defences at court.<\/p>\n<p>Once your Section 8 Notice has expired, you have to give at least 14 days\u2019 notice from the date of service. Your tenant may contact you and make part payment, so you can suspend further action as long as they pay on time.\u00a0 If the tenant has vacated the property, I would see this as a good result, as you have vacant possession and you have avoided the loss of a months\u2019 of non-payment and legal fees which can escalate into the thousands of pounds.\u00a0 At this point, it may be worthwhile mentioning the importance of <a title=\"Rent Guarantee and Legal Expenses\" href=\"https:\/\/www.lettingaproperty.com\/guaranteed-rent\" target=\"_blank\" rel=\"self noopener noreferrer\">rent guarantee insurance with legal expenses<\/a> the next time you have a vacant property and need to find tenants.<\/p>\n<p>I had one landlord a week ago, calling me, asking us to serve a Section 8 Notice as he had 15 months\u2019 rent arrears, I still get astounded now and that\u2019s after 28,000 instructions.\u00a0 If your tenant is in rent arrears and you need some help, <a title=\"Get in touch\" href=\"\/landlord\/advice\/how-to-evict-a-tenant\" rel=\"self\">please get in touch<\/a>.\u00a0 I would be happy to talk through your case.<\/p>\n<p>If you have been involved in rent arrears, how did you overcome it?\u00a0 Please share your comments below.<\/p>\n","protected":false},"excerpt":{"rendered":"<p><span class=\"span-reading-time rt-reading-time\" style=\"display: block;\"><span class=\"rt-label rt-prefix\">Reading Time: <\/span> <span class=\"rt-time\"> 2<\/span> <span class=\"rt-label rt-postfix\">minutes<\/span><\/span>This is the third article in my series of tenancy and property management tips for landlords.
