{"id":2455,"date":"2012-04-04T10:39:40","date_gmt":"2012-04-04T09:39:40","guid":{"rendered":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/?p=2455"},"modified":"2012-04-04T10:39:40","modified_gmt":"2012-04-04T09:39:40","slug":"landlord-responsibilities","status":"publish","type":"post","link":"https:\/\/www.lettingaproperty.com\/landlord\/blog\/landlord-responsibilities\/","title":{"rendered":"Landlord responsibilities when letting a property"},"content":{"rendered":"\n<p>Although most landlord responsibilities are\u00a0laid out in the <a href=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/sign-tenancy-agreement\/\" target=\"_blank\" rel=\"noreferrer noopener\">tenancy agreement<\/a>, unless using a <a rel=\"noopener noreferrer\" href=\"https:\/\/www.lettingaproperty.com\/landlord\/drafted-tenancy-agreement\" target=\"_blank\">plain English tenancy agreement<\/a>, the legal terms used can make deciphering your responsibilities somewhat of a challenge &#8211; even for legal boffs!<\/p>\n\n\n\n<p>Before entering into a tenancy agreement, the landlord should go through each section with the tenant.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">What are landlord responsibilities during a tenancy?<\/h2>\n\n\n\n<p>During a tenancy, a landlord is responsible&nbsp;for the exterior of the property including:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Doors and window<\/li><li>Walls and roofing<\/li><li>All gutters, drains and pipes<\/li><li>Garden walls, gates and fences<\/li><li>Gardens and patios \u2013 Although, in some cases, tenants are happy to take on this responsibility.<\/li><\/ul>\n\n\n\n<p><strong>A landlord also has specific obligations within the property and these include:<\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Interior electrical wiring and electrical sockets.<\/li><li>Radiators, water tanks and boilers.<\/li><li>Baths, basins, sinks and toilets.<\/li><li>If there&#8217;s a\u00a0gas supply\u00a0then\u00a0landlord responsibilities<strong>\u00a0<\/strong>include a <a href=\"https:\/\/www.lettingaproperty.com\/landlord\/gas-safety-certificate\">gas safety certificate<\/a>\u00a0every 12 months by a GasSafe\u00a0registered engineer.<\/li><li>The property should also have an up to date <a href=\"https:\/\/www.lettingaproperty.com\/energy-performance-certificate\" target=\"_blank\" rel=\"noreferrer noopener\">Energy Performance Certificate<\/a> &#8211; you can <a rel=\"noopener noreferrer\" href=\"https:\/\/www.epcregister.com\/\" target=\"_blank\">search the EPC register<\/a> to see if you have one.<\/li><li>All furnishings, white goods and other appliances are in good working order and safe to use.<\/li><li>A landlord is also responsible for dealing with any issues of internal damp caused by external faults.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">What are tenant responsibilities during tenancy?<\/h2>\n\n\n\n<p>The tenant is responsible for keeping the interior of the property and any furnishings clean and well maintained.<\/p>\n\n\n\n<p>This includes the repair of:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>All internal doors.<\/li><li>Any internal skirting boards.<\/li><li>All internal plasterwork.<\/li><li>The repair or replacement of any breakages caused by the tenant.<\/li><li>The replacement of blown light bulbs.<\/li><li>The removal of any blockages caused by the tenant from sinks, basins, baths and toilets.<\/li><li>The replacement of blown electrical fuses.<\/li><li>The tenant would be responsible to maintain the garden if they agree to do so.<\/li><\/ul>\n\n\n\n<p class=\"cta\"><a href=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/tenant-rights-when-renting-property-2021\/\" target=\"_blank\" rel=\"noreferrer noopener\">Related article: Tenant Rights When Renting Property In 2021<\/a><\/p>\n\n\n\n<h2 class=\"wp-block-heading\">The tenancy agreement<\/h2>\n\n\n\n<p>Both the landlord and tenant are bound to the terms of the tenancy agreement. &nbsp;However, there are occasions where even if the landlord has included certain tenant responsibilities, the&nbsp;tenant is not obligated to carry them out.<\/p>\n\n\n\n<p>This may include:<\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>When the landlord states that the maintenance of a gas boiler or appliance is the responsibility of the tenant. Under no circumstances should this responsibility fall on the tenant. \u00a0The landlord should ensure that a thorough check has been carried out on all gas appliances and boilers. He should also have a landlord\u2019s <a href=\"https:\/\/www.lettingaproperty.com\/gas-safety-certificate\" target=\"_blank\" rel=\"noreferrer noopener\">Gas Safety Certificate<\/a>\u00a0of which the tenant should receive a copy.<\/li><li>It is also highly unusual that a tenant should be expected to completely redecorate the property at the end of their agreement. \u00a0If the interior walls and ceiling of the property have been kept in good repair by the tenant and there is no mention of complete redecoration in the agreement then a tenant is not obligated to redecorate. \u00a0The landlord has no right to withhold their <a href=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/deposit-protection-schemes\/\" target=\"_blank\" rel=\"noreferrer noopener\">deposit<\/a>.<\/li><\/ul>\n\n\n\n<h2 class=\"wp-block-heading\">Landlord responsibilities towards the deposit<\/h2>\n\n\n\n<p>The deposit paid by the tenant at the start of their tenancy agreement is usually the equivalent to 1 month\u2019s rent (maximum of 5 weeks&#8217; rent). \u00a0By law, it is a landlord&#8217;s responsibility to secure the <a href=\"https:\/\/www.lettingaproperty.com\/landlord\/blog\/deposit-protection-schemes\/\" target=\"_blank\" rel=\"noreferrer noopener\">deposit<\/a> in a holding account with the <a style=\"user-select: auto;\" href=\"https:\/\/www.depositprotection.com\/\">Deposit Protection Service or DPS<\/a>. \u00a0 On vacating the rented property a tenant will need to apply to the DPS for the return of their deposit and a landlord has no right to withhold a deposit without good reason.<\/p>\n\n\n\n<p>However, there are some circumstances under which the landlord has a right to withhold some or even all the tenant\u2019s deposit. &nbsp;This may include an occasion where the tenant had caused damage to the property or furnishings belonging to the landlord and had not repaired or replaced the items.<\/p>\n\n\n\n<p>A landlord cannot withhold part or all of the tenant\u2019s deposit for general wear and tear of the property.<\/p>\n\n\n\n<p>Stay on top of all your landlord responsibilities with our free Landlord Checklist below:<\/p>\n\n\n","protected":false},"excerpt":{"rendered":"<p><span class=\"span-reading-time rt-reading-time\" style=\"display: block;\"><span class=\"rt-label rt-prefix\">Reading Time: <\/span> <span class=\"rt-time\"> 3<\/span> <span class=\"rt-label rt-postfix\">minutes<\/span><\/span>Although most landlord responsibilities are\u00a0laid out in the tenancy agreement, unless using a plain English tenancy agreement, the legal terms used can make deciphering your responsibilities somewhat of a challenge [&hellip;]<\/p>\n","protected":false},"author":2,"featured_media":8106,"comment_status":"open","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"footnotes":""},"categories":[33],"tags":[38,27,15,10],"class_list":["post-2455","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-property-law","tag-becoming-a-landlord","tag-energy-performance-certificates","tag-gas-safety-certificate","tag-tenant-referencing"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v27.3 - https:\/\/yoast.com\/product\/yoast-seo-wordpress\/ -->\n<title>Landlord responsibilities - Understanding your legal obligations<\/title>\n<meta name=\"description\" content=\"Landlord responsibilities are laid out in the agreement.
